This two-hour program, presented by Littler’s General Counsel and eDiscovery Counsel, will address how to safely navigate some of the most common and challenging ethical issues facing in-house counsel in labor and employment matters. Topics will include:

  • Joint representation of the corporation and the individual manager/supervisor
  • Privilege issues in investigations
  • Ethical “competence” for in-house lawyers in today’s digital age, especially considering the August 2012 amendment to ABA Model Rule 1.1 of the ABA Model Rules of Professional Conduct and the new tools that can blur ethical boundaries
  • Litigation hold challenges, especially in employment class and collective actions
  • Protecting confidential information/avoiding the inadvertent production of privileged information in discovery/gathering information ethically
  • Ethical minefields of communicating with employees through social media websites
