In the current highly-competitive business world, companies must be vigilant in taking measures to protect their trade secrets and to prevent former employees from raiding the companies' customers and employees. Unfair competition and the loss of a trade secret can cost companies millions of dollars in lost revenues. Unfortunately, the laws related to trade secrets and non-compete covenants are far from uniform. For example, a global non-compete template based on New York law may be completely unenforceable in numerous countries throughout Asia, Latin America and Europe. Accordingly, multinational employers must be aware of such distinctions and take aggressive precautions to protect themselves.

This program will feature highly experienced US, Latin American, and Asian employment counsel who routinely advise both in-house and external clients on the cross-border enforcement of non-competition agreements and other restrictive covenants. The program will include a discussion of the following issues:

  • Protecting trade secrets and proprietary information across national borders
  • Practical considerations for drafting non-competes or non-solicitation provisions in the multinational arena
  • Defining a "competitor" and proving an employee has gone to a competitor
  • Ensuring your confidentiality
