Employing People Abroad - Key Challenges for Employers with Large Numbers of Employees Abroad

The world is getting small, but unfortunately legislation, regulation and local practices vary very much from one country to another. This means that it may be very difficult for an employer who employs people in a number of different countries - either directly or through subsidiaries - implement group-wide policies while at the same time adhering to the national laws of each country.

We may as well face it: As long as rules vary significantly between countries, we will face problems when trying to set up global group policies, but if we do not face and address these problems, we will face even larger difficulties. Realising this, Novo Nordisk and Norrborn Vinding have decided to invite you to a one-day conference in Copenhagen. At the conference, a number of expert speakers will address these issues.

General Topics

  • Why do we try and set up global group policies and is it worthwhile?
  • Are there any alternatives to global group policies?
  • What kinds of challenges have Novo Nordisk experienced working with global group policies and how has Novo Nordisk addressed these issues?

Code of conduct/ethics

  • What factors to consider when drawing up the code of ethics/conduct?
  • How to implement globally the overall code of ethics/conduct set up by a parent company in, for instance, Europe?
  • How to sanction possible breaches of the overall code of ethics/conduct at the national level?
  • What will be the consequences if the way in which the global policies have been implemented in a country does not comply with local laws?

Personal data

  • How to transfer personal data across borders?
  • Does the individual employee need to consent?
  • What happens if the data is transferred in a manner which does not comply with local laws?

Practical issues when posting someone to work abroad

  • Should it be a secondment or local employment?
  • - What about choice of law issues - can we maintain someone on his/her home country legislation for a longer period of time?
  • - Will there be national host country rules applying to the employment relationship even if the employment relationship is from an overall perspective still under home country legislation?
  • - Should the employee have a contract with the home country company as well as a contract with the host country company or only with one of the companies?

All of the above issues will be addressed by highly specialised HR lawyers from Ius Laboris firms or Ius Laboris related firms in Brazil, China, India, Russia, the UK and the US in order for the conference participants to get an overview of what applies in the major receiving countries worldwide.

The conference will take place in Copenhages on [17/18] May 2010 from 9:00 to 17:00. Following the conference, there will be a networking dinner.

The conference venue will be Radisson SAS Falconer Hotel, Falkoner Alle 9, 2000 Frederiksberg, Denmark. It will be possible to book rooms at the hotel, which is close to the center of Copenhagen and within 20 minutes by Metro or 30 minutes by taxi from the airport.
