Employers Beware: Proposed New Regulations Will Dramatically Change the ADA

Managing employees with medical conditions is a complex and often frustrating process for employers. This process is about to become even more challenging. The Equal Employment Opportunity Commission published proposed regulations on September 23, 2009 to implement the ADA Amendment Act of 2008 that fundamentally change the rules under which employers have been operating over the last eighteen years. The proposed regulations, which are likely to be adopted without significant revisions, dramatically expand the definition of a disability and will require all employers to adjust how they handle employees with disabilities, requests for accommodation, and leaves of absence. We will examine the key differences between the new and old rules and how Employers should position their policies and practices accordingly.
