Employee Misclassification: The Risks and How You Can Avoid Them

Employee misclassification continues to be a major problem for employers. The U.S. Department of Labor (DOL) and the Internal Revenue Service recently identified employer misclassification of employees as independent contractors to be a top enforcement priority. Both federal and state agencies have hired more investigators and increased their enforcement initiatives to address this issue, and legislation is currently being considered that would further increase the liability for misclassification of independent contractors.

Similarly, both the DOL and New York State Department of Labor have made clear that investigating potential wage and hour violations is a top priority, and that a major focus is the misclassification of employees as exempt from overtime. Unfortunately, recent case law and pronouncements from the DOL have changed the landscape of overtime exemption for many positions, and brought further uncertainty and risk to employers. In addition to government initiatives, plaintiffs' attorneys continue to bring suits challenging the classification of employees as exempt across all industries.

This interactive and informative program will address the current administrative and legislative initiatives concerning the problem of employee misclassification, and provide practical guidance for preventative measures you can take to reduce your risk of a wage and hour investigation or lawsuit.
