The Supreme Court has made retaliation more difficult for employees by no longer allowing the use of the mixed motive burden of proof scheme. It has also made sexual harassment claims more employer-friendly by defining "supervisor" in a way that most sexual harassment claims will fall under co-worker's standards. Nonetheless, the EEOC continues to fight systemic discrimination by analyzing company policies to unearth any type of violation. This panel discussion among legal experts including Barry Hartstein and Celeste Yeager will bring you up-to-date on current discrimination laws and vet how these changes and the EEOC’s enforcement practices affect your daily employment related decisions.
