A year has passed since the adoption of the EEOC's Strategic Enforcement Plan (SEP). The coming year will also mark the 50th anniversary of Title VII's enactment. What was the EEOC's track record over the past year and what can employers expect in FY 2014?

In its SEP, the EEOC announced it would focus its efforts on broad-based systemic investigations and litigation, and specifically:

  • Barriers in recruitment and hiring
  • Protecting vulnerable workers
  • Emerging issues, such as reasonable accommodation under the ADA, pregnancy accommodation and LGBT issues
  • Equal pay
  • Preserving access to EEOC processes and attacking retaliation
  • Harassment on the basis of sex, race and other forms of harassment

We will review various highlights from Littler's Annual Report on EEOC Developments - Fiscal Year 2013, which provides a comprehensive overview of the significant cases, regulatory developments and other activities involving the EEOC.

  • EEOC's progress in implementing its SEP
  • Pending systemic litigation filed by the EEOC

  • EEOC systemic investigations and related subpoena enforcement actions
