Dramatic Employment Law Reforms in Italy: What an International Employer Needs to Know

Reforms that changed the legal landscape in Italy went into effect on July 18, 2012. Companies with employees in Italy need to be aware of these important developments. Among other reforms, the process for handling employee resignations and mutual terminations has been overhauled. The new law imposes a very specific procedure that must be followed under these circumstances. The failure to adhere to this process may render the resignation or mutual termination of an employee ineffective, a concept employers based in the U.S. will find both confusing and frustrating. The new law also changes the rules regarding the use of fixed-term employment contracts, apprenticeship contracts and independent contractor agreements. Finally, the remedies available to employees in unfair dismissal proceedings have been differentiated: reinstatement is no longer the exclusive remedy, as the court can order the employer to pay compensatory damages only.
These reforms change some of the important ground rules foreign employers must understand when hiring and managing a workforce in Italy.
