On September 17, 2013, the U.S. Department of Labor's Wage and Hour Division announced a final rule eliminating the Fair Labor Standard Act's minimum wage and overtime exemption for home care workers employed by home care agencies. The rule change will not go into effect until January 1, 2015 based on an anticipated challenge to the rule and to provide time for home care employers to prepare for the impact of the elimination of the FLSA's companionship exemption. This program will educate home care agencies concerning potential challenges to the new rule and on how best to prepare for this change to minimize its impact and protect against the potential minimum wage and overtime claims that are sure to be filed if and when it goes into effect.
