Rethinking Your Organization's Strategy for Regulating Employees Communication and the Use of Employees' Health Information

The U.S. Supreme Court's recent decision to review an employee's privacy challenge to his employer's review of text messages exchanged using an employer-issued pager through a service provider under contract with the employer has highlighted the increasing complexity of regulating employees' use of communications technology. The explosive growth of social networking, employees' use of personal e-mail accounts at work, and recent judicial decisions questioning the established underpinnings of e-mail policies have compounded the challenges for employers. At the same time, the Genetic Information Non-Discrimination Act of 2009 (GINA), which went into effect in November 2009, establishes broad new protection for employees health information with a substantial effect on benefits plans, wellness programs, and the collection and use of employees' health information. This breakfast briefing will explain the impact of these developments on your organization and provide you with practical strategies and policy recommendations for successfully addressing these new challenges for your business.
