The EEOC published its final regulations related to the Americans with Disabilities Act Amendments Act (ADAAA) on March 25, 2011. As you may know, on January 1, 2009, the ADAAA became effective, amending the ADA and greatly expanding the definition of "disability," potentially granting a new "disability" status to many more employees. For the last two years we have been operating without regulations interpreting the statute. These final regulations provide employers the EEOC's guidance on the ADAAA and redefine and mandate how employers treat employees with disabilities. We will walk you through the new regulations and offer advice on adjusting your policies and procedures to stay in compliance with the law.

Additionally, the EEOC recently has focused enforcement on two commonly used practices of employers: leaves of absence, as they relate to the ADA, and the adverse impact of criminal records background checks. Discussion leaders will explain the EEOC's initiatives and offer realistic solutions for adopting policies that will not run afoul of enforcement guidelines.

And finally, new regulations published by the EEOC, effective January 8, 2011, confirm that employers will need to make fundamental changes in long-standing practices to avoid violating the Genetic Information Non-Discrimination Act of 2008 (GINA). We will highlight the most pressing compliance issues for employers in light of the EEOC's new regulations and provide practical recommendations for handling those issues.
