The ADA Amendments Act of 2008

On September 25, President Bush signed into law an Act which makes major and important changes to the Americans With Disabilities Act.  The new law broadly expands the definition of a covered disability, eliminating consideration of most mitigating medicines and devices in deciding whether a disability exists, and broadens the circumstances in which a claim based on a perceived disability can be pursued. 

The ADA Amendments Act of 2008 was passed with the stated goal of broadening the ADA’s application and undoing several court decisions restricting claims under the ADA.  For employers, this is one of the most important new laws in years. 

This program examines the “new” ADA and what it means for employers and, just as importantly, discusses the measures that employers can and must take to insure compliance and avoid liability under this much broader Act.
