Today, issues affecting retirement plans, welfare benefits and executive compensation arrangements have greater significance to employers and employees than at any other time in recent memory. The Affordable Care Act continues to affect employers in ways that would have been hard to predict when the statute was enacted. The Act has altered hiring patterns, changed the rules of the game vis-à-vis contingent workers and has played havoc with the collective bargaining process.

In addition to the front page significance of the ACA, hardly a day goes by when we do not hear about either a class action or significant government inquiry which involves benefit plans. These issues may touch on plan investments and fees, plan governance and fiduciary issues, eligibility rules, company stock holdings, severance entitlements and executive compensation. And for the first time, the government has expended significant resources on reviewing health and welfare plan compliance.
