Employment Taxes

When it comes to taxes, employers are unique because they not only owe taxes for themselves, but have responsibilities for collecting and remitting taxes owed by their employees as well. Further, properly classifying workers as either employees or independent contractors can be difficult, and the tax consequences of making the wrong classification can be significant. These unique responsibilities make complying with the various state and federal tax laws complicated and confusing.

Littler's Employment Taxes Practice is a national preeminent tax practice exclusively dedicated to solving the difficult tax issues employers face. We have extensive experience handling numerous employment tax issues, including:

  • defending against federal and state audits for various employment related taxes, such as unemployment insurance taxes, income tax withholding, social security and Medicare taxes and state disability or similar taxes;
  • counseling employers with respect to worker status as employees or independent contractors, and drafting employment or independent contractor agreements;
  • providing due diligence on employment tax issues facing employers undergoing mergers, acquisitions and reorganizations;
  • reviewing and advising employers on the tax implications of various employer provided benefits, such as transportation benefits, meals and lodging for employees, or employer provided gifts for employees;
  • litigating employment tax disputes before the IRS, state administrative agencies and in state and federal court; and
  • advising on the tax implications of litigation settlements and jury awards, wage levies and garnishments, proper withholding for foreign employees temporarily in the United States on certain kinds of work visas, and numerous other tax issues that affect employers on a daily basis.
