Biography

Mr. Weissman is a shareholder in the Employment Taxes Practice Group. He represents employers in employment tax audits, protests and appeals before state taxing agencies and the IRS as well as litigation in civil court. Mr. Weissman also counsels clients on a broad range of employment tax matters, including handling garnishments, use of payroll debit cards, the proper classification of workers as employees or independent contractors and the tax implications of various employer provided benefits. He is currently the Chair of the Employment Taxes Committee of the American Bar Association's Tax Section and the Chair of the Employment Taxes Subcommittee of the ABA Business Law Section's Tax Committee.

Mr. Weissman is formerly tax counsel for the California Franchise Tax Board ("FTB"), where he served in the Multistate Tax Bureau. While at the FTB, he was involved in numerous highly complex and significant matters, including acting as counsel for the FTB in Appeal of Crisa Corp., a landmark case addressing distortion in the apportionment formula. He has extensive experience in numerous aspects of state and local taxation.

Publications

Mr. Weissman is a frequent speaker and author on employment tax issues, and has a regular column, "Taxing Times," in State Tax Notes. He is also a co-author with Ms. MacDonnell of two chapters in the portfolio series LexisNexis Tax Advisor – Federal Topical on the Federal Insurance Contribution Act and the Federal Unemployment Tax Act. He also co-authored the chapter "Is the taxpayer/worker an employee or an independent contractor for IRC purposes?" in the American Bar Association two-volume treatise called: "Effectively Representing Your Client before the IRS - A practical manual for the tax practitioner (4th Edition)." He is also the author of the chapter on independent contractors in CEB's Annotated Employment Document Guide, to be published in late 2010 or early 2011.
